Peaceful Assembly Act 2012 was legislated by the Malaysian Parliament in 2012 in conjunction to the right to assemble peaceably and without arms, to provide restrictions which are deemed to be necessary or expedient relating to such right in the interest of the security of the Federation or any part thereof or public order, including the protection of the rights and freedom of other persons, and to provide for related matters. There are different opinions regarding the function of the rights and responsibilities of this Act in maintaining stability of the public order. Those who oppose this Act believe that the function of the rights and responsibilities are efforts intended to prohibit any forms of assembly being organized vis-à-vis Section 27, Police Act 1967 which has been annulled. However there are some who believe that the function of this rights is precise nevertheless, still requires responsible roles for public order to perpetuate. This research is intended to analyze the function of the rights and responsibilities of the Act and whether it is to prohibit any types of assembly or to perpetuate the public order. Some function of the rights and responsibilities are evaluated to see how far the Act has given the function of the rights and responsibilities to the organizers, participants, persons who have interest and the police, as well as, to identify the restraints in implementing the triumph of this Act. This study was based on library research and interview. This research concludes that the Act has given fair and reasonable rights and responsibilities to the organizers and participants, persons who have interests to inform their concerns or objections and the police as the facilitator for keeping the public order. Even though this Act does not prohibit any citizens from organizing or participating in peaceful assembly without arms, there are rights and responsibilities in this Act which still require improvement to guarantee the assembly can be organized without affecting the public order.
