The foreign worker policy is considered as weak and inefficient, primarily due to the ineffective policy instruments used by the government in managing foreign workers. Continued reliance on weak instruments in policy implementation will impact policy performance. Therefore, this study was conducted with the objective is to examine the allegations regarding the inability of the policy instrument, by evaluating three forms of policy instruments in managing foreign workers, namely legislative, economic and communicative. This study seeks to answer three main questions. First, to what extent do legislative, economic and communicative instruments affect the performance of foreign worker management policies? Second, does collaborative governance mediates the relationship between policy instruments and the performance of foreign worker management policies? Third, how can the performance of foreign worker management policies be improved more effectively based on a collaborative governance approach? This study adopts a mixed method approach. Quantitative data analysis involved a total of 223 respondents, while 8 participants were involved in the qualitative data analysis. The results of the quantitative study indicate that legislative, economic, and communicative instruments, through the mediation of collaborative policy making and implementation, have a small predictive affect on the performance of foreign worker policies with a small predictive level of 39.7%. From the mediator’s perspective, the analysis reveals that only collaborative policy-making significantly mediates the relationship between economic and communicative instruments and policy performance. In contrast, collaborative policy implementation does not mediate the relationship between the three instruments with policy performance. The qualitative findings also shed light on factors that contribute towards the ineffectiveness of policy instruments, such as unclear policy goals, weak monitoring and enforcement, the absence of a suitable foreign worker supply mechanism for the construction industry, and weak online systems. Based on these findings, this study suggests that each category of policy instruments should be strengthened.
