Under Sabah Town and Country Ordinance Cap 141 the provision of ten percent of titled land for open space is a legal requirement for every land development which has an area of more than one acre. Concurrently through the provision of section 49(1)(53) of Sabah Local Government Ordinance,1961 the Local Authorities perform the functions for the establishment,control and management of open spaces within their jurisdiction. Unfortunately many of the open spaces in housing areas are not maintained and managed efficiently by the Local Authorities even some pf them abandoned. It is timely to check the loopholes and make recommendations to make sure all the open spaces established can be controlled and managed efficiently by the Local Authorities so that from the findings it can be used to enhance the monitoring and management of open spaces for the betterment of the residents in the housing areas. Hence a study based on questionaires,interview,observation and documentation reviews has been carried out. From this study outcome it is found that many of these open spaces in the housing areas are still under the names of original land owners/developers and are yet to be surrended to the Local Authories. Due to this problem the Local Authorities are facing the difficulty in maintaining and managing the open spaces.
