Summary: | Linguistically talak means to set free. In syara' talak means to set free or end the
marriage bondage with certain particular words or statements that bring to the effect
of ending the marriage bondage. Eventhough Islam permits ending of this bondage or
talak, it is the most hated thing of the permissible acts. This research paper is to look
into more detail and to give awareness on the laws and guidance regarding talak.
Allah S.W.T. has given us the guidelines on the commitment of talak, which must not
be used arbitrarily, but as the last resort of ending the marriage after it has gone
beyond reconciliation. Though this research entitled "Talak According To The Al-
Quran And Sunnah", other inputs or words regarding the subject are being practiced,
such as lia'n, khulu', ila', firaq and zihar. Eventhough the words are different from
one another, they bring the same consequences in divorce matters, such as the ex-wives
have the rights to material properties, they have to undergo the iddah period
before remarrying. |
