Summary: | This study focuses on divorce by the ground of Faraq whether by the wife or
prosecution by the Religious Council of the State, whereas according to Islamic
principles and statutory provisions in Islamic Family Law of Federal Territories Act
1984 (Act 303). Furthermore, the methodology of research that is used in this study is
through library research and observation on cases which conducted in the Syariah
Court of Federal Territory of Kuala Lumpur. Besides that, the study is also related to
the divisions of other types of dissolution of marriage or Faraq, its causes and the
implications to the children, wife and husband after Faraq. It is also to identify the
jurisdictions of the Syariah Court of Federal Territories and the example besides of
cases that involved in Faraq marriage. |
