يهدف هذا البحث إلى دراسة المعايير الضرورية التي لا بدّ أن تتوفر في عملية تنزيل الحكم الشرعي؛ لتحقيق مبدأ الوسطية كي تسري مسارها صحيحةً سليمةً، دون انحراف وتزليق. وتثير مشكلة البحث تلك المعايير التي لها التأثير الحقيقي على مناطات الأحكام والتي تحقيقها ضرورية في الأفراد والجماعة، مع شروط العمل بهذه المعايير وحدوده. ويحاول الباحث أن يجيب عن الأسئلة الآتية: ما مفهوم معايير الوسطية؟، وما مفهوم تنزيل الحكم الشرعي؟، وما هي تلك المعايير الضرورية التي يجب أن تتوفر في عملية تنزيل الأحكام؟. وقد استخدم الباحث في هذا الصدد منهجًا استقرائيًّا لجمع المادة العلمية، وآخر تحليليًّا لتحديد هذه المعايير وماهيتها وضرورة العمل بها. ومن أهم ما توصل إليه الباحث من النتائج خلال مسيرته البحثية؛ هو أنّ المعايير التي لا بدّ من مراعاتها لتحقيق منهج الوسطية في تنزيل الحكم الشرعي سواء أكان في الاجتهاد الفردي أم الجماعي، عبارة عن "تغيّر الزمان، والمكان، والعرف، والحال، والمعلومات، ووجه المصلحة" بجانب "مراعاة مقاصد الشريعة، ومآلات الأفعال، واستشارة أهل الاختصاص، وتحقيق المناط بما فيه مراعاة العادة والفروق الفردية، والعمر، ونية المستفتي"، وكل منهج لم يتوفر فيه هذه المعايير ولم يوظفها فيه توظيفًا حقيقيًا فلا يعتبر منهجًا وسطًا ولو توهم ذلك متوهم. This research aims at investigating the necessary standards required in the process of identification of Sharia rulings to attain the principle of moderation so that it runs its course correctly and soundly without deviation or equivocation. The research problem indicates to those standards that have real effect on the extraction of the grounds of the rulings and which implementation is necessary for the community and individuals, whilst mentioning the requirements and limitation of the application of these standards. The researcher endeavours to answer the following questions: What is the concept of moderation standards? What is the concept of Sharia ruling identification? What are these necessary standards required in the process of rulings’ indentification? To answer these questions, the introspective approach and analysis have been adopted to achieve the objectives. The research journey concluded that these standards include “time change, location, customs, state, details and the interest orientation” along with “taking into account the Sharia objectives, the consequences of deeds, the consultation of experts, and attaining the desired result without ignoring individual differences, customs, age and the intention of the fatwa seeker”. These standards should be considered to achieve the moderation path in adopting the Sharia ruling both in Individual or collective ijtihad; as any approach without these standards whereby they are not utilized fully is not a moderate approach but an illusion. The study consists of two main axes: an explanation of the research terms, such as the statement of the concept of moderation and the application of the Sharia ruling. The second axis contains those standards that must be available in the rulings’ identifiction approach to be a moderate and neutral between the parties, void of excess or negligence.
