الحمد لله الذي رفع منزلة العلماء المخلصين الصادقين، والصلاة والسلام على النبي محمد الذي حذَّر من الإفتاء بغير علمٍ وبصيرةٍ، وعلى آله وأصحابه الذين تهيَّبوا من مقام الإفتاء. وبعد: فلقد احتلَّ الإفتاء منزلةً عظيمة في المفهوم الإسلامي؛ لأنه توقيعٌ عن ربِّ العالمين، وتبيانٌ لحكم الله تعالى في المسألة المسؤول عنها، ومسؤوليةٌ كبرى يترتب عليه آثارٌ على الفرد والمجتمع. وقد حذَّر الإسلام من التصدُّر للإفتاء بغير علمٍ، وعدَّه من التقوُّل على الله تعالى بما لم يقل، وهو مسئولية كبرى، وموبقةٌ عظمى؛ إذ يفضي إلى إضلال الناس، وخراب البلاد والعباد. ولعظم موقع الإفتاء، فإنَّ الأصوليين بحثوا في مؤلفاتهم مبحث الفتوى، وسنَّوا شروطًا عديدة، ومعايير شرعية؛ لضبط مسار الإفتاء، وتأطير إطاره بالضوابط الشرعية؛ حتى يضحى المفتي مؤهلاً للإفتاء، وتصدر الفتوى صحيحًا سليمًا موافقًا لجوهر الشريعة الإسلامية، ومراعيًا في الوقت عينه فقهَ الواقع المعاش، ومصالح العباد.
