يختصُّ هذا البحث بدراسة أحد مناهج النظر في الفروع الفقهية وتأليفها عند الفقهاء، وهو المنهج المعتمد على استخلاص الاختلافات الدقيقة من المسائل الفقهية المتشابهة التي تؤدي إلى تباين الأحكام الفقهية لتلك المسائل، وهو ما يعرف بفن الفروق الفقهية. وستحاول هذه الدراسة عرض مفردات هذا الفنّ بإلقاء الضوء على مصطلح الفروق الفقهية نفسه من حيث تعريفه ومفهومه. وإضافة إلى ذلك، يتناول البحث تأصيل فنّ الفروق الفقهية من خلال بعض القضايا الأصولية والفقهية التي تؤسس فكرة التفريق. وكما يذكر البحث الشروط في الفروق الفقهية من جانب صحّة اعتبارها، وسلامة تنزيلها. This study focuses on one of the jurists’ methods in dealing with the details of juristic issues. This method consists in unearthing subtle differences and nuances among similar juristic issues; whereby such differences and nuances require different rulings for those apparently similar issues. This field of study is known as the art of juristic nuances (fann al-furËq al-fiqhiyyah). The article examines the component elements of this field of study and sheds light on the term of juristic nuances to elucidate its meaning and technical definition. Then, the study looks into the theoretical underpinnings of the art of juristic nuances by examining a number of propositions in Islamic legal theory (uÎËl al-fiqh) and positive law (fiqh) that lend the foundation of juristic nuances. Finally, the study enumerates the conditions governing the theoretical consideration and practical implementation of juristic nuances.
