Summary:Under the National Land Code 1965 (“NLC”) , State Director is assigned with certain powers that may be exercised in relation to administration and enforcement of the Code. However there are circumstances where the State Director’s actions in exercising his powers have been questioned by certain party, for instance by the registered proprietors. The aim of this article is to analyze the extent of powers of State Directors in relation to process of land development that partly involve the application for alienation, re-alienation, conversion and sub division. This is also may extend to powers of the State Directors in relation to the estate land that is controlled by the Estate Land Board (“ELB”) due to the fact that there are many instances where the land development is undertaken on the land that previously was used for plantation. Clear understanding on their powers will assist the speedy process of land development that will contribute to the economic growth in the country.
