Description
Summary:In this new edition, the book has been completely revised and extensively rewritten. In Chapter 3 (Relationship between International and National law), sections on the British practice and the practice of Australia and New Zealand have substantially been revised by reference to recent judicial decisions. In Chapter 5 (State Territory), the seminal Palmas Island case has been thoroughly rewritten and the ICJ’s judgment on Pulau Batu Puteh case has also been scrutinized in-depth to illustrate the notion of effectivit`es. In Chapter 6 (State Jurisdiction), the application of subjective and objective territorial principles are updated by referring to the very recent decision of the Pre-trial Chamber of the ICC on crimes against humanity against the Rohingya and the contemporary notion of cybercrimes. In Chapter 10 (Law of the Sea), the extremely popular topic of South China Sea disputes, the nine-dash line claim of China, and the principle that the land dominates the sea, are addressed. In Chapter 14 (The Legal Regulation of the Use of Force), the most recent military invasion of Ukraine by the Russian Federation is critically analyzed. A new Chapter 16 (International Criminal Law) is added for those who are interested in the punishment of perpetrators of international crimes and the role of the ICC.
